These Terms of Use (the "Terms") govern your use of all websites or mobile websites owned or operated by Kalison Studios Education, LLC ("Company," "us," "we"), including the website currently located at www.kalisonstudios.com (the "Site"), and any applications, interactive features, widgets and resources that may be offered by Company through traditional Internet websites, mobile devices or other platforms or services (all of which, together with the Site, may sometimes be collectively referred to as the "Properties" and each individually as a "Property"). Except for posting User Content as enabled on a Property, you shall not send us any unsolicited creative materials such as stories, screenplays, treatments, or other creative work ("Unsolicited Submissions"). If you send us any Unsolicited Submission despite this, we take no responsibility and will have no liability with respect to the use of such Unsolicited Submission. You acknowledge that Company has wide access to ideas, stories, designs, and other creative materials, and that new ideas are constantly being submitted or developed internally.
Other than User Content, we own or license all aspects of the Properties and the content they contain, including text, works of authorship, software, scripts, graphics, photos, sounds, music, videos, interactive features (collectively, "Content") as well as trademarks, service marks, trade names, logos, domain names, and any other brand elements (collectively, "Marks"). The Content and Marks are protected by copyright, trademark and other intellectual property laws and by international treaties.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEITHER COMPANY NOR ANY OF THE COMPANY AFFILIATES WILL BE LIABLE UNDER ANY THEORY OF LIABILITY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF REVENUES, PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO USE OF THE PROPERTIES.

Any controversy, claim, or dispute arising out of or related to these Terms shall be solely and exclusively resolved through binding arbitration conducted according to the Rules of the American Arbitration Association. The arbitration shall be conducted in Los Angeles County before a single neutral arbitrator. No disputes may be arbitrated on a class or representative basis. By entering into these Terms, you irrevocably waive any right you may have to join claims with those of others in the form of a class action or similar procedural device.
These Terms will be governed by and construed in accordance with the laws of the State of California, without giving effect to any conflict of laws rules or provisions.
By using the Properties you consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
The Properties are controlled, operated and administered within the United States of America. If you access the Properties from a location outside of the United States, you are responsible for compliance with all local laws.
From time to time, we may change these Terms. If we change these Terms, we will inform you by posting the revised Terms on the Site. By continuing to use the Properties, you agree to the revised Terms.
